Milieu protection areas remain a relevant topic with wide-reaching effects. We track developments across Berlin's boroughs and summarise the current status here for you.

Introduction: why this topic still matters

Milieu protection areas don't appear out of nowhere. They are the result of a long lead time of applications, council decisions and studies. Once a preservation statute is in place, experience shows it tends to stay in force indefinitely, and it has a direct effect on your property. Even decades after the first milieu protection areas were introduced in Berlin, uncertainty remains high.

  • Converting buildings into individually owned condominiums is now only possible to a limited extent in milieu protection areas. On top of milieu protection, Section 250 of the German Building Code (BauGB) applies in Berlin, making conversions in strained housing markets subject to approval.
  • Milieu protection limits the structural and economic development of residential properties. Modernisation work, floor-plan changes, conversions and certain changes of use become subject to approval or can be prohibited.
  • How does milieu protection affect a sale? Milieu protection influences the purchase price, the pool of buyers and a property's development prospects. Restrictions on modernisation, conversion and use often lead to more conservative calculations and longer due-diligence processes.
  • What does milieu protection mean for energy-efficiency upgrades? Energy-efficiency modernisation generally remains possible, but in milieu protection areas it is often subject to approval. The deciding factor is whether the measures count as standard, up-to-date maintenance or lead to a substantial change in fit-out and rent levels.

Many questions about milieu protection get answered in blanket terms or with a simple yes or no. Yet some provisions of the preservation statutes, the formal name for milieu protection areas, are supplemented or extended by higher-ranking legislation. One example is the federal ban on condominium conversions in strained housing markets, in force since 2021.

Party positions on milieu protection

The effect of milieu protection is contested. Supporters see it as a tool for protecting existing tenant communities; critics point to weaker investment incentives, interference with property rights, complicated and opaque approval procedures and decisions, and obstacles to modernisation and climate targets. The positions of Berlin's parties on milieu protection therefore differ considerably.

Housing policy is a permanent top issue in Berlin, and with the election to the Berlin House of Representatives coming up, preservation statutes are likely to become a campaign topic. Future majorities are open, and several possible coalitions would have very different housing-policy consequences: CDU-led coalitions tend to be investment-friendly, while red-green-left alliances are clearly regulation-oriented.

Milieu protection in the boroughs

Milieu protection is no longer a matter for a few inner-city locations. With 82 social preservation areas now in place, the instrument shapes investment decisions, modernisation options and development strategies across large parts of Berlin's housing market.

  • Pankow: 14 areas Pankow has one of the densest networks of social preservation areas in Berlin. The borough is examining further expansions, including around Weißer See. Follow-up reviews are due in 2026 for seven existing areas.
  • Friedrichshain-Kreuzberg: 11 areas Friedrichshain-Kreuzberg is considered one of the most active boroughs in enforcing milieu protection. In 2026, the Hornstraße and Kreuzberg-Nord areas were newly designated. In parallel, the borough is tightening its approach to furnished short-term lettings.
  • Charlottenburg-Wilmersdorf: 9 areas The borough is currently focusing on follow-up reviews of existing areas such as Jungfernheide, Mierendorff-Insel and Alt-Lietzow. Further designations are politically contested.
  • Mitte: 14 areas Mitte has the highest number of social preservation areas in Berlin. Follow-up reviews are pending for several areas, while funding and staffing are coming under increasing pressure.
  • Tempelhof-Schöneberg: 10 areas The borough is not currently pursuing active expansion of milieu protection. The focus is on updating and reviewing existing areas.
  • Neukölln: 10 areas Neukölln is one of the boroughs regulated early outside the inner S-Bahn ring. Follow-up reviews for several areas are due from 2028; additional funding has not yet been secured.
  • Treptow-Köpenick: 3 areas With Alt-Treptow and Ober- and Niederschöneweide, the borough recently expanded its milieu protection. Further reviews are considered possible.
  • Steglitz-Zehlendorf: 3 areas With Feuerbachstraße, Gritznerstraße Nord and Mittelstraße, this traditionally cautious borough has had social preservation areas for the first time since 2024.
  • Lichtenberg: 3 areas The Kaskelstraße, Weitlingstraße and Fanningerstraße areas are the focal points of milieu protection in the borough. No further expansions are currently known.
  • Reinickendorf: 2 areas The borough has taken a cautious approach so far. Follow-up reviews and preparatory assessments for further areas are under way in parallel.
  • Spandau: 3 areas Alongside Wilhelmstadt and Spandauer Neustadt, Stresow was also designated a social preservation area in 2025. Further candidate areas are assessed differently on political and structural grounds.
